A Federal Guidance Memo from the Department of Education may indicate a Title IX roadblock in the way of schools ability to pay NIL and revenue sharing to athletes. The memo hints the monies would fall under the guidelines of scholarships which would require equal distributions among genders. Possibly not an insurmountable obstacle that can be negotiated within the House Settlement plaintiffs, the conferences, the court, and the DOE.
